若5月1日出勤，屬於例假日：原則上雇主不得要求員工出勤，除非天災、事項或突發事宜，可按勞基法第40條請求員工上班，但須加發1日之工資，也就是36,000÷30=1,200元，還得過後補假。
若4月30日出勤，屬於歇息日：雇主應於原月薪以外，以時薪較量爭論支付加班費，公式為：150元×2小時×4/3+150元×6小時×5/3=1,900元。

根據勞動基準法第39條，若雇主在本年勞動節連假第一天（4月30日）、勞動節（5月1日）或勞動節補假（5月2日）當天徵得員工贊成出勤，工資需要加倍發給，計較公式依假別辨別。舉月薪36,000元（換算時薪為36,000元÷30日÷8小時=150元）、固定周一到周五上班的勞工出勤8小時為例：

但也有些職業因工作性質不適用勞基法，而是以其他法令規範。像是醫事人員適用醫事人員人事條例，軍公教也有各自專屬法令，出勤、放假規範有所不同，勞動節當天不見得能夠放假。
勞動基準法第2條明定，勞工是指「受雇主僱用從事工作獲致工資者」，也就是說只要在勞基律例範下的受雇者，都能在勞動節當天依法放假。
